Function of the Position:
This managerial position is responsible for leading a contracts administration team embedded with the Africa region, supports the entire portfolio of projects and new business activities for this team. The incumbent serves as advisor to the Africa Regional Managing Director, Regional Finance and Operations Manager, and Project Delivery Team (PDT) Directors. The position reports to the Director of Contracts.
Roles and Responsibilities:
- Provides overall guidance to Proposal Teams on complex contractual issues including:
- Participating in new business strategies including discussions on identifying risks and analyzing these risks for a bid decision.
- Reviewing and analyzing USAID solicitations to understand the terms and conditions and convey any unique or risky contract terms to Proposal and Project Managers.
- Providing guidance to recruiters, proposal teams and Subcontract Negotiators on allowances and salary offers.
- Preparing contractual clarification questions in response to requests for proposals.
- Provides guidance and support to Subcontract Negotiators in the selection of subcontract types, effective negotiations with subcontractors, analyzing budgets, effective negotiation of subcontract terms and conditions, and responding to BAFOs.
- Provides input to and advice on cost proposals for submission during Green team meetings.
- Interfaces and negotiates with government client to help resolve contract issues.
2. Contract Management
- Supports the Project Delivery Teams within the Africa Region in the administration of its contracts. Specific tasks include:
- Supervising, mentoring, and guiding a team of junior and/or mid-level contract professionals.
- Leading a contract administration team responsible for supporting the Africa Region by providing expert advice regarding business management, contracts, subcontracts, and grant issues.
- Conducting complex client, subcontractor, and grantee negotiations, including negotiation of extraordinary or unusual terms and conditions.
- Timely resolution of internal and external issues/problems related to contract administration.
- Serving as primary point of contact with internal and external customers on complex/critical contract, subcontract, and grant matters.
- Reviewing and analyzing complex contract/subcontract and other legal agreements.
- Monitoring compliance with contract terms and conditions. Ensuring contracts, subcontracts, and grants comply with applicable regulations, corporate policy, and good commercial practice.
- Preparing complex contracts, subcontracts, grants, and other documentation.
- Reviewing/approving work products of mid-level and junior contract administration staff.
- Training and providing day-to-day supervision to, and responsibility for full performance management of assigned staff.
- Providing authoritative guidance on contracts, subcontracts, grants, and general business management issues to operational group staff at all levels.
- Being responsible for accurate and timely maintenance of contract data in the Oracle system.
3. Corporate Initiatives and Training
- Provides input in the development of contracts tools and templates for use by Contracts and Project Delivery Teams
- Provides input in the development of contracts-related training materials for DAI staff.
- Grade 10: Minimum of 9 years of progressive experience in contracts administration, negotiation, pricing, or other relevant experience and a Bachelor’s degree; or 7 years of progressive experience in contracts administration, negotiation, pricing, or other relevant experience and a Master’s degree.
- Grade 11: Minimum of 11 years of experience in contracts administration/management, negotiation, pricing, subcontracts or procurement and a Bachelor’s degree; or 9 years of experience in contracts administration/management, negotiation, pricing, subcontracts or procurement and a Master’s degree.
- Demonstrated working knowledge of CPFF, T&M, FP, and/or IDIQ contracts.
- Experience working with USAID contracts.
- Ability to mentor and train individual contracts administrators.
- Ability to work independently with minimal supervision.
- Experience working with USAID contracts as well as with other donors.
- Self-motivated, entrepreneurial, results-oriented, and customer service-minded.
- Experience utilizing technology to introduce innovation to improve effectiveness and efficiencies. Demonstrated ability to build, lead, and manage effective teams.
- Demonstrated ability to communicate effectively with external clients and internally with all levels of the organization.
- Demonstrated organizational skills, and a capacity to handle multiple tasks under tight deadlines.
